Diapers, Feminine Hygeine Products are Tax-Free In California

Diapers, feminine hygiene products and menstrual pads are now tax-free in California. Gov. Jerry Brown signed a bill Thursday banning taxes on diapers and tampons. The law goes into effect January 1, 2020. Eliminating the tax was one of the first major policy proposals by Assemblywoman Lorena Gonzalez Estrada, D-San Diego, who is running for state treasurer in 2020. She said women often have to choose between purchasing diapers or tampons because they cannot afford both items at once.

“Women shouldn’t have to choose between diapers and tampons,” Gonzalez said in a statement Thursday. “They shouldn’t be put in a position where they have to ration their health care.”

The Tax Foundation found that there are at least 11 states with sales taxes on some or all incontinence products like adult briefs (3), diapers (2), pull-ups (2), bed pads or underpads (6)

A new law passed in California will make diapers and feminine hygiene products tax-free. The bill was one of the first major policy proposals by Assemblywoman Lorena Gonzalez Estrada, who said that she wanted to help families with their finances.

The law goes into effect on January 1, 2020 and bans taxes on all diapers except for those used as medical devices or for incontinence care products like adult diapers or pull-ups (which must be sold in packages of five or more). It also bans taxes on tampons and menstrual pads; however, taxes will still apply to other feminine hygiene products such as douches and deodorants.

Assemblywoman Lorena Gonzalez Estrada introduced the legislation back in February 2019 after learning that California residents had been paying sales tax on feminine hygiene products for years without realizing it was happening or having any say in whether they wanted to pay it or not — even though there were no similar taxes levied on other products like food and health care items such as vitamins and toothpaste.

Assemblywoman Lorena Gonzalez Estrada, D-San Diego, was a co-author of AB 1561, which eliminated sales tax on feminine hygiene products including tampons, pads and liners; menstrual cups; panty liners; menstrual sponges; cervical caps; facial tissues used as toilet paper or baby wipes (but not paper towels); toilet seat covers sold with dispensers installed inside bathrooms (but not those sold by themselves); sanitary napkins used as outer garments such as dresses or skirts made from elastic fabrics

Women are often forced to choose between purchasing diapers and tampons because they cannot afford both items at once. This puts women in a position where they have to ration their health care, which is unacceptable.

We need to make sure that no woman is put in this situation: she should be able to buy whatever she needs without having to worry about money or other issues getting in the way of her ability to care for herself and her family members.
